MASTER TERMS & CONDITIONS OF SERVICE
Exterior Cleaning Services

These Terms & Conditions apply to exterior cleaning services provided by Coastal Fresh Cleaning (“Coastal Fresh Cleaning”, “the Business”, “we”, “us” or “our”) to the person, business, body corporate, property manager or other entity engaging our services (“the Client”, “you” or “your”).
These Terms are intended to clearly establish the responsibilities of both Coastal Fresh Cleaning and the Client and to provide transparency regarding the nature, limitations and inherent risks of professional exterior cleaning.
By accepting a quotation, paying a deposit, confirming a booking, instructing us to proceed, providing access to the property or permitting work to commence, the Client acknowledges that they have had an opportunity to read and understand these Terms & Conditions and agrees to be bound by them.
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded or modified under the Australian Consumer Law or other applicable legislation.
1. SCOPE OF SERVICES
Coastal Fresh Cleaning specialises in professional exterior cleaning.
Services may include:
• Roof cleaning and soft washing
• House washing
• Building washing
• Pressure cleaning
• Driveway and concrete cleaning
• Paths, patios and outdoor areas
• Gutter cleaning
• Solar panel cleaning
• Exterior window and glass cleaning
• Fence and wall cleaning
• Commercial exterior cleaning
• Body corporate and townhouse complex cleaning
• Exterior property maintenance cleaning
• Other exterior cleaning specifically included in an accepted quotation
Only services specifically identified in the accepted quotation, invoice, written agreement or booking confirmation are included.
Any additional work requested before or during the service may require an additional quotation or charge.
2. CLEANING IS MAINTENANCE — NOT RESTORATION
The Client acknowledges that exterior cleaning is a cleaning and maintenance service.
Unless specifically quoted otherwise, our services do not constitute:
• Painting
• Repainting
• Roof restoration
• Recoating
• Rendering
• Building repairs
• Waterproofing
• Plumbing
• Electrical work
• Structural repairs
• Pest control
• Surface resurfacing
• Material replacement
• Construction or renovation work
Cleaning cannot reverse normal ageing, weathering or deterioration.
A surface may remain faded, oxidised, stained, corroded, discoloured, deteriorated or otherwise imperfect after it has been professionally cleaned.
3. QUOTATIONS
Quotations are based on the information reasonably available at the time they are prepared.
This may include:
• Information supplied by the Client
• Photographs
• Satellite or online imagery
• Property measurements
• Visual inspection
• Site inspection
• Estimated surface area
• Expected contamination levels
• Accessibility
A quotation may be revised where the actual property, scope, accessibility or condition materially differs from the information available when the quotation was prepared.
This can include undisclosed additional areas, substantially heavier contamination, inaccessible areas, unusual hazards or conditions requiring additional equipment, labour or treatment.
Any material variation will be discussed with the Client where reasonably practicable before additional chargeable work proceeds.
4. BOOKING & DEPOSIT
Unless otherwise agreed in writing, a 50% deposit is required to secure a booking.
The deposit must be received within 48 hours of acceptance of the quotation unless another period is stated in writing.
A requested service date is not considered secured until the required deposit has been received.
If the deposit is not received within the required period, Coastal Fresh Cleaning may release the proposed booking date to another customer.
The remaining balance is due on the day the service is completed unless different payment terms have been agreed in writing.
5. CANCELLATION & RESCHEDULING
Our scheduling system allocates equipment, travel time and working capacity to each booking.
Where a Client requests that a confirmed booking be moved to another date, a $220 rescheduling fee may apply and must be paid before a replacement date is secured.
Clients should provide at least 24 hours’ notice when requesting a change.
Same-day changes may be treated as a cancellation or missed appointment where we have already allocated labour, equipment and travel to the booking.
Where a Client cancels or prevents the service from proceeding at short notice, Coastal Fresh Cleaning may retain amounts reasonably reflecting losses, costs and resources committed to the booking, subject always to applicable law.
Nothing in this section affects rights available under the Australian Consumer Law.
6. WEATHER & OPERATIONAL RESCHEDULING
Exterior cleaning is weather dependent.
Rain does not automatically prevent exterior cleaning, and certain services can safely and effectively be completed during light or moderate rain.
However, we may postpone, suspend or reschedule work because of:
• Severe weather
• Lightning
• Excessive wind
• Unsafe roof conditions
• Extreme weather conditions
• Equipment failure
• Access restrictions
• Water restrictions
• Safety concerns
• Circumstances beyond our reasonable control
Where Coastal Fresh Cleaning reschedules a service for operational or safety reasons, the Client will not be charged the Client-requested rescheduling fee solely because of that decision.
Safety takes priority over the scheduled date.
7. CLIENT PROPERTY PREPARATION
Before our scheduled arrival, the Client must take reasonable steps to prepare the property.
This includes:
• Closing and securely latching all windows and doors
• Moving vehicles away from work areas
• Providing clear access
• Unlocking required gates
• Removing outdoor furniture where practical
• Removing toys and decorations
• Moving portable pot plants
• Removing clothing and washing from clotheslines
• Moving or protecting signage and stock
• Securing pets
• Keeping children away from work areas
• Identifying sensitive items
• Isolating, protecting or moving vulnerable electrical equipment
• Advising us of known leaks or defective seals
• Advising us of existing damage or unusual property conditions
The Client is responsible for losses or additional work arising from their failure to reasonably prepare the property, except to the extent caused or contributed to by Coastal Fresh Cleaning’s failure to exercise reasonable care and skill.
8. ACCESS & UTILITIES
The Client must provide reasonable and safe access to all areas included in the quotation.
Unless otherwise agreed, an adequate working external water supply must be available for the duration of the service.
Where access or essential utilities are unavailable and the service cannot reasonably proceed, the booking may need to be rescheduled and reasonable additional costs may apply.
9. PRE-EXISTING CONDITIONS
Exterior cleaning can reveal deterioration that was previously concealed by dirt, mould, algae or other contamination.
The Client must advise us of known:
• Water leaks
• Failed window seals
• Failed door seals
• Roof leaks
• Loose roofing
• Loose tiles
• Cracked surfaces
• Loose render
• Peeling paint
• Failed coatings
• Oxidation
• Corrosion
• Damaged gutters
• Loose fittings
• Electrical defects
• Waterproofing problems
• Structural weaknesses
• Previous repairs
• Other vulnerable areas
We are not responsible for the underlying failure of a material or component merely because that failure becomes visible or manifests during normal cleaning performed with reasonable care and skill.
10. AGED, WEATHERED & DETERIORATED SURFACES
Older exterior surfaces naturally deteriorate.
Possible conditions include:
• Oxidation
• Chalking
• Fading
• UV deterioration
• Paint breakdown
• Coating failure
• Corrosion
• Rust
• Brittle materials
• Loose paint
• Deteriorated render
• Failed sealants
• Porous surfaces
• Weathered timber
Cleaning may expose, reveal or make these existing conditions more visually noticeable.
Where a coating or material has already failed, cleaning cannot restore its original colour, gloss, adhesion or structural integrity.
11. PAINTED & COATED SURFACES
The Client acknowledges that painted and coated exterior surfaces vary substantially according to:
• Age
• Paint type
• Preparation
• Application quality
• Previous maintenance
• UV exposure
• Salt exposure
• Moisture exposure
• Previous chemicals
• Existing oxidation
Where paint or coating adhesion has deteriorated, normal cleaning may expose loose or failing material.
Coastal Fresh Cleaning will use cleaning methods we reasonably consider appropriate for the surface and condition observed.
Where substantial deterioration is identified, we may recommend assessment by an appropriate painter, roofer or other trade professional.
12. COLORBOND®, METAL ROOFING & COATED METAL
Coated steel and metal surfaces may experience oxidation, fading, corrosion, coating deterioration and environmental contamination over time.
Where applicable, we consider relevant manufacturer maintenance and cleaning guidance when selecting a cleaning method.
The Client acknowledges that cleaning cannot restore a coating that has already deteriorated or reverse corrosion, oxidation, fading or coating failure.
Existing inconsistencies may become more apparent after contamination has been removed.
13. ROOF CLEANING
Roof cleaning involves specialised access, cleaning solutions, water and safety equipment.
We determine the cleaning process according to factors including:
• Roofing material
• Roof pitch
• Accessibility
• Existing condition
• Organic contamination
• Coating condition
• Safety requirements
Our preferred method for suitable roofing is controlled soft washing rather than unnecessary high pressure.
Some organic contamination may continue to lighten, break down or naturally release following treatment.
Immediate complete disappearance of every mark is not guaranteed.
14. PRESSURE CLEANING
Pressure cleaning is generally used on surfaces reasonably suitable for mechanical cleaning, including certain concrete and hard surfaces.
Pressure cleaning cannot guarantee removal of:
• Deep oil staining
• Rust penetration
• Permanent discolouration
• Paint staining
• Tyre marks that have penetrated the substrate
• Mineral deposits
• Existing surface defects
• Previously etched areas
Cleaning may expose variations already present within concrete, paving or other substrates.
15. SOFT WASHING & CLEANING SOLUTIONS
Professional soft washing may involve cleaning solutions designed to treat organic contamination.
The concentration, application method, dwell time and rinsing procedure may vary depending on:
• Surface type
• Surface condition
• Contamination
• Temperature
• Weather
• Environmental conditions
The Client acknowledges that exterior cleaning cannot be completely isolated from surrounding environmental conditions.
Coastal Fresh Cleaning will take reasonable precautions appropriate to the service.
16. PLANTS, LAWNS & VEGETATION
Vegetation is a living environment and individual plant response cannot be guaranteed.
Where appropriate, Coastal Fresh Cleaning may:
• Pre-wet vegetation
• Rinse vegetation
• Control application direction
• Reduce overspray
• Manage runoff where reasonably practicable
• Adjust procedures according to weather conditions
The Client must advise us before work begins of rare, valuable, delicate, newly planted, unhealthy or particularly sensitive vegetation.
Portable plants should be moved from work areas where reasonably possible.
Clients may independently cover or otherwise protect vegetation they consider particularly sensitive before our arrival.
Plant health can be affected by numerous factors unrelated to cleaning, including:
• Heat
• Sunlight
• Drought
• Excessive watering
• Poor drainage
• Waterlogging
• Soil condition
• Disease
• Pests
• Salt exposure
• Existing plant stress
• Suitability to Queensland climatic conditions
Leaf spotting, yellowing, browning or leaf drop does not necessarily indicate plant death or establish the cause of the plant’s condition.
Nothing in this section excludes liability where loss is directly caused by our failure to exercise reasonable care and skill.
17. OVERSpray, MIST & DRIFT
Pressure cleaning and soft washing inherently generate water, mist and spray.
Wind, building height, surface angles and water rebound can carry fine droplets beyond the immediate cleaning area.
We take reasonable precautions to control overspray; however, complete containment cannot always be guaranteed.
The Client must ensure sensitive items near work areas are moved or appropriately protected.
18. NEIGHBOURING PROPERTIES
The Client is responsible for notifying adjoining neighbours or businesses where cleaning activity may reasonably affect them.
Neighbours should be encouraged to move or protect:
• Vehicles
• Caravans
• Trailers
• Washing
• Clothing
• Outdoor furniture
• Pot plants
• Sensitive equipment
• Other valuable items
Coastal Fresh Cleaning does not undertake neighbour notification unless specifically agreed in writing.
We remain responsible for exercising reasonable care and skill when performing the service.
19. WATER INGRESS
Exterior cleaning involves substantial quantities of water.
Modern exterior surfaces are generally designed to withstand ordinary weather exposure; however, pressure cleaning and soft washing may expose weaknesses that normal rainfall does not reveal.
Water may enter through:
• Failed seals
• Deteriorated window seals
• Open windows
• Open doors
• Vents
• Cracks
• Damaged roofing
• Defective flashing
• Unsealed electrical penetrations
• Deteriorated building components
• Existing construction defects
The Client must advise us of known vulnerabilities before work begins.
Coastal Fresh Cleaning is not responsible for water ingress caused by an existing defect or failure of the building envelope except to the extent our failure to exercise reasonable care and skill caused or contributed to the loss.
20. ELECTRICAL EQUIPMENT
The Client must identify and appropriately protect or isolate vulnerable external electrical equipment before cleaning.
This includes exposed or damaged:
• Power points
• Lighting
• Wiring
• Switchboards
• Appliances
• Pumps
• Machinery
• Electronic equipment
Following cleaning, electrical equipment should be allowed to dry completely before being re-energised.
If there is any concern that water has entered electrical equipment, it should be inspected by a suitably qualified electrician before use.
21. DRAINAGE & RUNOFF
Exterior cleaning necessarily creates water runoff.
The Client is responsible for informing us of known:
• Blocked drainage
• Inadequate drainage
• Damaged drains
• Internal drainage connections
• Shared drainage systems
• Septic systems
• Greywater systems
• Sensitive runoff areas
• Site-specific environmental requirements
Where reasonably practicable, we will manage cleaning water consistently with the circumstances and applicable requirements.
Special containment, recovery, filtration or wastewater-management services must be disclosed and agreed before work if they are required beyond the normal scope of the quoted service.
22. RAINWATER TANKS
The Client must tell us before roof, gutter or related cleaning if the property is connected to a rainwater collection system.
Rainwater tanks may require isolation from roof runoff during cleaning.
Where a temporary diversion is installed by Coastal Fresh Cleaning, it is a temporary measure associated with the cleaning service and not a permanent plumbing installation.
Unless otherwise agreed, temporary diversion equipment installed by us will be removed when our service is completed.
The Client remains responsible for deciding when the rainwater system should subsequently be returned to normal operation and for the suitability of stored water for its intended use.
Where drinking water is involved, the Client should obtain appropriate professional advice or testing if there is uncertainty regarding water quality.
23. GUTTER CLEANING
Gutter cleaning is intended to remove accessible accumulated debris from the agreed areas.
It does not constitute:
• Plumbing inspection
• Roof inspection
• Gutter repair
• Downpipe repair
• Leak detection
• Waterproofing
• Structural certification
We cannot guarantee that an existing damaged, poorly designed or restricted drainage system will operate correctly after cleaning.
24. SOLAR PANEL CLEANING
Solar panel cleaning is limited to cleaning accessible panel surfaces included in the quotation.
We do not provide:
• Electrical testing
• Solar performance certification
• Electrical repairs
• Panel installation inspection
Existing cracks, loose components, electrical faults, deteriorated seals or installation defects remain outside the scope of the cleaning service.
No particular increase in electrical output or energy production is guaranteed.
25. WINDOWS & EXTERIOR GLASS
Where exterior glass cleaning is included, results depend on the condition of the glass.
Cleaning cannot remove or repair:
• Glass scratches
• Etching
• Mineral damage
• Failed double-glazing seals
• Fabrication defects
• Existing hard-water damage that has permanently etched the glass
• Construction damage
A general rinse associated with a house or roof cleaning service is not equivalent to a dedicated professional window-cleaning service unless window cleaning is specifically included in the quotation.
26. TIMBER, WRAPS & SENSITIVE SURFACES
Untreated timber, weathered timber, vehicle or caravan wraps, decals, oxidised surfaces and other sensitive materials can react differently to water and cleaning solutions.
The Client must identify known sensitive materials before work begins.
Where we reasonably determine that cleaning may present an unacceptable risk, we may modify the cleaning method, exclude the area or decline to clean it.
27. STAIN & CONTAMINATION REMOVAL
Unless specifically guaranteed in writing, we do not guarantee complete removal of every:
• Rust stain
• Oil stain
• Mineral stain
• Paint mark
• Efflorescence
• Organic stain
• Lichen mark
• Tyre mark
• Construction residue
• Permanent discolouration
Some contamination can chemically or physically alter the underlying material.
Cleaning can remove contamination without being capable of reversing permanent surface alteration.
28. RESULTS & EXPECTATIONS
Cleaning results depend on:
• Property age
• Surface type
• Surface condition
• Previous maintenance
• Previous treatments
• Contamination severity
• Environmental exposure
• Location
• Weathering
• Existing deterioration
Coastal, beachfront, forested, shaded, humid and heavily vegetated properties may experience more rapid recurrence of environmental contamination.
We cannot guarantee how long a cleaned surface will remain free of:
• Mould
• Mildew
• Algae
• Lichen
• Salt
• Dirt
• Organic growth
• Environmental staining
29. REGULAR MAINTENANCE
Regular exterior cleaning can assist in controlling environmental contamination but does not stop natural ageing or material deterioration.
Maintenance frequency varies according to property conditions.
Some properties may benefit from annual maintenance, while others may require more frequent attention because of coastal exposure, vegetation, shade or manufacturer-specific recommendations.
Any maintenance recommendation provided by Coastal Fresh Cleaning is general unless expressly stated otherwise.
Manufacturer requirements applicable to a particular material should take precedence.
30. SITE SAFETY
During the service, the Client and all occupants must:
• Remain clear of active work areas
• Keep children and pets away
• Avoid wet or recently treated surfaces
• Avoid hoses and equipment
• Follow reasonable safety directions
• Not interfere with machinery or cleaning solutions
Wet surfaces can be slippery.
Where access through an active work area is required, the Client should speak with us first so work can be safely paused where practicable.
31. EQUIPMENT
Clients, occupants, employees, contractors and visitors must not:
• Operate our equipment
• Move our equipment without permission
• Drive over hoses
• Disconnect hoses
• Adjust valves
• Interfere with chemical equipment
• Use our ladders or access equipment
Where a person associated with the property negligently or intentionally damages our equipment, the Client may be responsible for the reasonable repair or replacement cost to the extent permitted by law.
32. WORKING AT HEIGHT & ACCESS
Roof and high-level work is subject to safe access and working conditions.
If we determine that an area cannot be safely accessed using the equipment available, we may:
• Exclude the area
• Modify the cleaning method
• Reschedule that component
• Recommend specialised access equipment
• Provide an additional quotation for required access equipment
No employee or contractor is required to perform work we reasonably consider unsafe.
33. RIGHT TO STOP OR REFUSE WORK
Coastal Fresh Cleaning may refuse to commence, temporarily suspend or permanently stop work where there is a reasonable safety, legal or operational concern.
This includes:
• Unsafe property conditions
• Aggressive or threatening behaviour
• Harassment or intimidation
• Interference with equipment
• Suspected fraudulent or deceptive conduct
• Uncontrolled animals
• Unsafe electrical conditions
• Unsafe roof access
• Severe weather
• Undisclosed hazardous materials
• Instructions that would require unsafe or unlawful work
Where work is stopped because of Client conduct or an undisclosed site condition, reasonable charges may apply for work already performed and costs reasonably incurred.
34. ZERO TOLERANCE FOR AGGRESSION, HARASSMENT & INTIMIDATION
Coastal Fresh Cleaning maintains a safe working environment.
Aggressive, threatening, intimidating, abusive, discriminatory or seriously confrontational behaviour towards our staff or contractors will not be accepted.
Where a person at the property behaves in a manner that reasonably causes a worker to feel unsafe, we may immediately stop work and leave the property.
This includes threats, physical intimidation, deliberate obstruction, abusive behaviour or interference with our equipment.
The safety of our workers takes priority over completion of the service.
35. FRAUDULENT OR DECEPTIVE CONDUCT
Coastal Fresh Cleaning does not tolerate fraudulent or deliberately deceptive conduct.
This includes intentional falsification of information, deliberately misleading claims, manipulated evidence or dishonest conduct connected with a booking, payment or dispute.
Nothing in this section prevents a Client from genuinely raising a complaint, exercising a statutory right or providing legitimate evidence regarding the service.
36. PHOTOGRAPHS & SERVICE RECORDS
Coastal Fresh Cleaning may photograph or record relevant work areas before, during and after service for legitimate business purposes including:
• Condition documentation
• Quality control
• Safety
• Quotation verification
• Service records
• Dispute resolution
Any public marketing use involving identifiable private information will be handled appropriately.
Clients should advise us before service if there are specific privacy concerns.
37. COMPLAINTS & RECTIFICATION
If the Client believes there is a problem with the service, they should notify Coastal Fresh Cleaning as soon as reasonably practicable after discovering the issue and provide sufficient information for us to investigate.
Where appropriate, we should be given a reasonable opportunity to inspect the relevant area and determine an appropriate response.
The Client should take reasonable steps to prevent further loss or damage while an issue is being investigated.
Nothing in this clause restricts statutory rights or remedies available under applicable law.
38. DAMAGE CLAIMS
A claim that damage resulted from cleaning should reasonably identify:
• The affected area
• The nature of the alleged damage
• When it was discovered
• Relevant photographs or other information
We may compare the claim with pre-service photographs, property condition, service records and other relevant evidence.
Pre-existing deterioration, ageing or material failure is distinguished from damage actually caused by the cleaning service.
Where our failure to exercise reasonable care and skill causes damage, the matter will be handled consistently with applicable law and the circumstances.
39. CLIENT’S DUTY TO MITIGATE LOSS
Where a problem occurs, both parties should take reasonable steps to prevent avoidable additional loss.
The Client should not knowingly allow an issue to worsen where reasonable action could limit further damage.
Urgent safety matters, including suspected electrical hazards or significant water ingress, should be appropriately isolated and referred to a qualified trade professional where required.
40. PAYMENT
Unless otherwise agreed in writing, the outstanding balance is payable on the day of completion.
Payment methods may include:
• Bank transfer
• Card/Stripe
• Cash
• Tap payment
The Client must not unreasonably withhold payment for undisputed work.
Where part of an invoice is genuinely disputed, the undisputed amount remains payable unless otherwise required by law.
41. OVERDUE ACCOUNTS
Where an account becomes overdue, Coastal Fresh Cleaning may take reasonable steps to recover the debt.
The Client may be responsible, to the extent permitted by law, for reasonable external recovery costs actually incurred as a result of an overdue undisputed debt.
Nothing in this clause permits the recovery of amounts prohibited by law.
42. COMMERCIAL & BODY CORPORATE CLIENTS
The person accepting the quotation confirms they have authority to engage Coastal Fresh Cleaning on behalf of the relevant business, owner, body corporate, property manager or other entity.
Commercial clients must ensure employees, contractors, residents, customers and visitors comply with reasonable temporary access restrictions while cleaning is underway.
The Client must disclose site-specific induction, access, environmental or safety requirements before the scheduled service.
43. THIRD-PARTY CONTRACTORS
Coastal Fresh Cleaning is not responsible for defects, damage or contamination caused by other contractors before, during or after our service.
Where other trades are working at the property, the Client must coordinate access so our work can be performed safely.
We may postpone work where another contractor’s activities make the work area unsafe or materially interfere with the service.
44. ENVIRONMENTAL CONDITIONS
Exterior cleaning takes place in an uncontrolled outdoor environment.
Conditions including:
• Wind
• Rain
• Heat
• Humidity
• Sunlight
• Coastal salt
• Vegetation
• Drainage
• Airborne contamination
can influence cleaning procedures and results.
We may modify our cleaning process where reasonably necessary because of environmental conditions.
45. FORCE MAJEURE & EVENTS OUTSIDE REASONABLE CONTROL
Neither party will be treated as having breached the agreement solely because performance is prevented or materially delayed by circumstances outside their reasonable control.
Examples can include severe weather, natural disasters, government restrictions, significant equipment failure, road closures, emergency events or other circumstances that could not reasonably have been avoided.
The parties will cooperate reasonably to reschedule or otherwise address the affected service.
46. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Coastal Fresh Cleaning is not responsible for loss arising solely from:
• Pre-existing defects
• Undisclosed vulnerabilities
• Ordinary wear and tear
• Ageing
• Failed coatings
• Existing corrosion
• Oxidation
• Defective seals
• Poor workmanship by third parties
• Existing structural defects
• Client failure to reasonably prepare the property
• Client or third-party interference with equipment
• Events outside our reasonable control
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms excludes the Australian Consumer Law consumer guarantees where they apply.
47. AUSTRALIAN CONSUMER LAW
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing contained in these Terms & Conditions is intended to exclude, restrict or modify any statutory consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where there is any inconsistency between these Terms and a mandatory provision of applicable law, the mandatory legal provision prevails to the extent of the inconsistency.
48. DISPUTE RESOLUTION
If a dispute occurs, both parties should first attempt to resolve the matter directly and reasonably.
The Client should provide details of the concern and allow Coastal Fresh Cleaning a reasonable opportunity to investigate.
Where appropriate, the parties may consider mediation or another suitable dispute-resolution process before commencing formal proceedings.
Nothing in this clause prevents either party from exercising statutory rights or seeking urgent legal relief where appropriate.
49. COMMUNICATION
Important notices relating to:
• Booking changes
• Cancellations
• Complaints
• Property vulnerabilities
• Scope changes
• Disputes
should preferably be provided in writing by email, SMS or another written communication method used between the parties.
Written communication helps both parties maintain an accurate record.
50. VARIATIONS TO THESE TERMS
Coastal Fresh Cleaning may update these Terms & Conditions from time to time.
Unless otherwise permitted by law or agreed by the parties, updated Terms apply to future bookings or agreements entered into after the effective date of the updated Terms.
Terms applicable to an existing confirmed booking will not be retrospectively changed merely to disadvantage the Client.
51. SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be read down to the extent legally possible.
If it cannot be read down, it may be severed without invalidating the remainder of the Terms where the agreement can continue to operate.
52. NO WAIVER
If either party does not immediately enforce a contractual right, this does not automatically mean that right has been permanently waived.
Any waiver applies only to the particular circumstances in which it is given unless expressly stated otherwise.
53. ENTIRE AGREEMENT
These Terms, together with the accepted quotation, written scope of work, invoice and any expressly agreed written variations, form the agreement between Coastal Fresh Cleaning and the Client concerning the service.
Where there is a specific written term in an accepted quotation that conflicts with a general provision of these Terms, the specifically agreed written term will prevail to the extent of that inconsistency, subject to applicable law.
54. GOVERNING LAW
These Terms are governed by the laws applicable in Queensland, Australia.
The parties submit to the jurisdiction of the courts and tribunals having jurisdiction in Queensland, subject to any rights that cannot lawfully be restricted.
55. CLIENT ACKNOWLEDGEMENT
By accepting a quotation, paying a deposit, confirming a booking, providing access to the property or permitting Coastal Fresh Cleaning to commence work, the Client acknowledges that:
• They have had an opportunity to read these Terms & Conditions.
• They understand exterior cleaning involves water, equipment and, where appropriate, cleaning solutions.
• They understand cleaning is maintenance and not restoration.
• They understand results depend on the existing condition of the property.
• They agree to reasonably prepare the property before service.
• They will disclose known defects, sensitive areas and vulnerabilities.
• They will notify us of rainwater tanks and sensitive vegetation where applicable.
• They will keep people and animals away from active work areas.
• They understand environmental contamination can naturally return after cleaning.
• They understand that pre-existing deterioration may become more visible once contamination is removed.
• They agree to pay amounts properly due under the accepted quotation and these Terms.
• They understand that nothing in these Terms removes any rights that cannot legally be excluded.
